Regular Meetings
The Perry Township Board of Trustees meets in Regular Meeting format on the first and third Tuesday of every month at 7:00 PM.
The meetings are held at the Township Hall located at
3111 Hilton Street NW
in Massillon. Regular Meetings include reports by Department Heads, the Law Director, and the Township Administrator. The public is welcome to offer comments during the Public Speaks portion of the agenda on township related matters.

Trustee Laubacher made a motion to approve bills and payroll in the amount of $130,166.47 for the week ending September 9, 2014 and bills in the amount of $39,684.49 for the week ending September 16, 2014 for a combined total of $169,850.96; Seconded by Trustee Chessler.

Consider Resealing of Township Administration and Fire Administration Parking Lots
Fire Chief Martin stated that the Fire Department is requesting that the Board of Trustees authorize the use of TruLine Asphalt Sealer in Canton, Ohio to seal coat the Fire and Administrative parking lots at a cost not to exceed $2,725.00. Chief Martin stated that the cost of the seal coating will be split evenly between the Fire and Township Administration. It has been two (2) years since the parking lots have been repaved and that is the recommended time to start to conduct preventative maintenance. Chief Martin stated that he has provided three (3) quotes, attached before the Board. Chief Martin stated that TruLine is the lowest bid and recommends that we use them for the seal coating.
Trustee Chessler stated that based on the information provided by the Fire Chief and the review of the bids before the Board, makes a motion that the Board approve entering into an agreement for the sealing of the parking lots with TruLine Asphalt at a cost not to exceed $2,725.00; Seconded by Trustee Haines.

Consider Request for Proposal (RFP) to purchase Hydraulic Rescue Tools
Fire Chief Martin stated that the Fire Department is requesting that the Board of Trustees authorize the solicitation of bids for two (2) sets of hydraulic rescue tools. Chief Martin stated that if the Board approves that, the bids request will be posted in the Massillon Independent on September 19th and 26th, 2014. The bid submission will be open on Tuesday, October 7, 2014 at 7:00 pm. As the Board is aware, the Fire Department was awarded $69,000.00 from the Federal Government to purchase two (2) sets of hydraulic tools. We did establish a committee which looked at the various tools that are out there and then developed a set of specifications. We are at the point now where we want to submit those specs for solicitation of bids. The Law Director has reviewed the specs and the associated documents that go along with that and has given his legal approval.
Trustee Chessler made a motion that the Board authorize the advertisement of the bid specifications the Fire Department has developed with the hydraulic tools and we will make the required advertising and solicit bids for the purchase of those items if the bid specifications are met and will award the bid on Tuesday, October 7, 2014; Seconded by Trustee Haines.

Chief Martin stated that the Fire Department was awarded a $1,000.00 grant from Marathon Oil to purchase mass casualty trauma supplies. Chief Martin indicated that this grant money will be used to purchase supplies for rapid trauma to stop hemorrhage.
Trustee Laubacher stated that the Township has received a check in the amount of $1,000.00 from the McKinley Eagles. $500.00 of this amount is set to be given toward the upcoming police levy and $500.00 of this amount is to go toward Halloween candy.

Public Speaks-Open Forum:
Ben Moretta, 5232 Southway St. SW, Canton, Ohio 44706 – Mr. Moretta stated that this is in regard to commercial property owned by Mr. Red Chambers. Mr. Moretta stated that there is a zoning notice commercial property maintenance code notification violation sent out on 12-18-12 in which Zoning Inspector Weckbacher outlined everything Mr. Chambers was to follow through with and the majority of these tasks have not been completed; and he wanted to see if there was a reason as to why not.
Trustee Laubacher stated that the last thing the Township had received from Law Director Hall was that no recognition of the letter had come back to us.
Trustee Haines stated that something was just sent to Mr. Chambers in the last two (2) months, discussed at the last meeting, stating that he has not come into compliance yet and there was a court order at one time that he has not followed. Trustee Haines stated that it is their understanding that his wife has passed away and this has caused more personal issues with him and has held up things in court as well. Trustee Haines stated that this matter has not been forgotten and it is an ongoing battle.
Mr. Moretta stated that the court order on the County Justice Information System (CJIS) site does show that it is closed and is not open or active anymore. Mr. Moretta stated that after doing some research on the parcel numbers that Zoning Inspector Weckbacher has on the notification, the total from all the properties that has been sent notifications, has back taxes owed in the amount of $68,144.73 and some of the delinquent dates go back to August 2009. Mr. Moretta stated that this sets a poor example for everybody.
Trustee Chessler stated that if on the CJIS site a case is designated as closed as in this matter, if we go back to court with a court order, called a continued jurisdiction, and if the property owner is out of compliance with the court order, we can go back under that same case number. Back taxes through the county treasurer would have to seek a foreclosure through the prosecutor’s office but if there is a compelling reason to an issue for foreclosure action, that can be done through them. Trustee Chessler stated that the Township can advocate through the county treasurer to take some action on these delinquencies. Trustee Chessler also stated that we will continue to pursue the zoning and maintenance codes in this matter.
Trustee Laubacher gave a brief summary in regard to another property owner on Southway making complaint in reference to Mr. Chambers’ properties also.
Joyce Bair, 166 Manor Ave. NW, Canton – Mrs. Bair stated that she and her husband have lived at this property for about 30 years and has come here this evening to inquire about the property that Canton City owns across the street from them. Mrs. Bair briefly explained about being at the Board meeting in July regarding this matter. Mrs. Bair stated that the City of Canton has decided at some point not to mow this area except around the edges and was here to find out what more, if anything, has developed.
Trustee Laubacher briefly explained about the Township previously looking into this matter years ago with the intent of making this area a park but stated that the Army Corp of Engineers had made issue with not disturbing the area due to the species of insects. Trustee Laubacher also added that there is a pipe in this area that is part of the Dannemiller ditch that takes the water out of that area making it more like a retention pond.
Trustee Chessler affirmed of Trustee Laubacher regarding Perry Township exploring the previous consideration of making this area feasible for ball fields. Trustee Laubacher stated that was correct but added that this would not happen unless the Corp of Engineers wanted to change their decision. Trustee Chessler stated that he would call Mr. Gordon, Canton City Park Director, to remind him of their commitment to mow this area at least one more time this season.
Mrs. Bair inquired what would happen next year in reference to the mowing maintenance.
Trustee Chessler stated that the problem is that Perry Township is probably the only one that would be legally capable of taking ownership of this land because that land was dedicated to park use and a private person could not do that. Trustee Chessler stated that Canton could or our Township could because Canton wanted to give this land to us, but added that we would be taking on the headache that they are trying to get rid of in regard to the cost of mowing and maintaining. Trustee Chessler added that we can communicate with them that this is their responsibility and we expect them to be a good neighbor because they have not been.
Mrs. Bair inquired if Canton City would still deny that they will continue to maintain and mow, who would put pressure on them to take care of this responsibility. Mrs. Bair also added that she had contacted the mayor’s office regarding this matter and they had replied that the mayor had no jurisdiction over this.
Trustee Chessler replied that the Park Board is a separate entity from the mayor’s office. The Park Board oversees the park functions in the city of Canton. Mr. Gordon is appointed with that Board as the Park Director, just as this Board directs the Police Chief and Fire Chief of what the policies and expectations are, the Board can too.
Trustee Haines inquired if the Park Board has regular meetings. Trustee Chessler stated that they do and added that this might be a place to go to direct these concerns. Trustee Chessler asked if Mrs. Bair would leave her telephone number with him after this evening’s meeting and stated that he would call her to give her this information.
Trustee Laubacher inquired if it was a possibility that the City of Canton would turn over the gas well in this area and then in turn use the money to be able to take care of the property. Trustee Chessler stated that this would be a topic for negotiation.
Bard Huntsman, 4025 Prosway Ave. SW, Richville – Mr. Huntsman stated that Becky Anania couldn’t be here this evening and had asked him to relay her thanks for being so attentive with the issues at her husband’s grave site at the Richville Cemetery.
