Trustee Laubacher made a motion to approve bills in the amount of $29,010.17 for the week ending October 18, 2011; Seconded by Trustee Capaldi.

Consider 2011 Millage- Total Millage 12.15- Total Amount $5,292,338.00
Mr. Schlegel asked the Board to approve the 2011 millage. Total millage is 12.15 with the total amount of $5,292,338.00.
Trustee Chessler made a motion that the Board approve the calculated total millage presented by the Fiscal Officer as 12.15 total mills which generates $5,292,338.00 in tax revenue; Seconded by Trustee Laubacher.

Administration:
Consider Authorizing COSO Media to Proceed with Proposed Website Edits
Administrator Fetzer stated that on October 17, 2011 she had an opportunity to meet with the Department Heads and office staff regarding the three (3) website proposals provided by Matt DeWees of COSO Media. The proposal was unanimously chosen based on what best suited the Township’s needs. The Board received a copy of the chosen proposal as well as a copy of the current website design for their review and consideration.
Trustee Chessler inquired if the proposed changes to the agreement have been made to Mr. Hall’s satisfaction. Mr. Hall stated that COSO Media has agreed to all proposed changes in the agreement and it is ready for approval. Administrator Fetzer stated that both the COSO Media and The Karcher Group hosting contracts have been edited accordingly, signed by the Board President, and distributed to all parties.
Administrator Fetzer stated that the next step is to hold a Department Head meeting to determine the proper utilization of photos and content. IT and computer needs will also be discussed at that time for each department. Trustee Capaldi verified that no formal action needed to be taken at this time. Administrator Fetzer stated that was correct.

Police Department:
Consider Donation of $550.00 from the McKinley Eagles for Trick-or-Treat Candy
Chief Pomesky asked the Board to consider accepting a $550.00 from the McKinley Eagles for trick-or-treat candy to be passed out by the Police Department. Trustee Chessler stated that the McKinley Eagles has done a lot of great things for the community. Mr. Schlegel researched the last five (5) years and found that the McKinley Eagles have donated approximately $24,000.00 to Perry Township. The McKinley Eagles also donates generously to the schools and sport organizations.
Trustee Capaldi made a motion that the Board accept the $550.00 donation from the McKinley Eagles; Seconded by Trustee Chessler.

Consider Police Department Labor Management and Safety Representatives
Mr. Hall stated that the union contract of the Police Department has a provision to create a labor management committee. Traditionally in the past the Board and Police Department was represented on that committee by the Board President, Chief of Police and Administrator. Mr. Hall stated that the Police Department has had a Deputy Chief for two (2) years. If you read the Deputy Chief’s job description, he is probably by job description the third person that the Department would like to see appointed to represent that labor management committee. Mr. Hall asked the Board to consider modifying the representatives of the Police Department Labor Management and Safety Committee to include the Board President, Chief of Police and Deputy Chief. Most of these matters are internal police matters having to do with different issues that arise from time to time. This gives the department an opportunity to handle departmental concerns and avoid going through the grievance and arbitration process. The Deputy Chief, if you look at the job description, could really lend a better representation in that type of setting. Trustee Chessler inquired what document this matter was set forth in. Mr. Hall stated that it is included in all Police Department union contracts; Police Officers/ Detectives, Sergeants and Dispatchers. Before the Deputy Chief position was created the Administrator was involved. Mr. Hall stated that according to the job description for the Deputy Chief and being that Deputy Chief Carbenia has been in this position for two (2) years, they would like to see him slotted into that position. Trustee Chessler inquired if this was Chief Pomesky’s preference as well. Chief Pomesky stated that was correct. Trustee Laubacher inquired if the situation called for it if the Administrator could take the position back. Mr. Hall stated that would be the Board’s decision to make. Trustee Capaldi stated that the Board would have to use their judgment and if the situation was related to Administration then obviously that would be something that the Administrator would do.
Trustee Chessler made a motion that the Board reconstitute the positions that will comprise the Labor Management and Safety Committee for the Police Department, that being the Chief of Police, Deputy Chief and designee of the Board of Trustees; Seconded by Trustee Capaldi.

SERB Notice- Perry Township Board of Trustees vs. Perry Organized Workers
Mr. Hall stated that the Board received a notice from SERB stating that there is probable cause on one of the union’s allegations of an unfair labor practice charge. In turn, there is probable cause on one of the Board’s allegations of an unfair labor practice charge. Mr. Hall stated that the next step is for the staff attorney for the State Employment Relations Board to draft a complaint and serve it to both the Board and the Perry Organized Workers. After that, the process starts to prove all of the facts. Mr. Hall stated that he will keep the Board updated as matters progress.
Consider Fire Union Negotiation Representation
Mr. Hall stated that the Board has received a notice to negotiate from the Fire Department for wages only. The Board will need to appoint a negotiating committee to include the Law Director, Fire Chief and Deputy Chief as needed. There should also be a Board designee as well. Trustee Laubacher volunteered to be the Board designee because the firemen had asked him to sit in on it. Trustee Chessler stated that this is not the kind of duty that someone would jump and leap at with anticipation. Trustee Chessler stated that typically these negotiations extend for several months and by rotation he will be the Board President next year and assumed that would be the case and he would agree to do it, not with a love for it but out of the necessity for it. Trustee Chessler stated that Trustee Laubacher served last time and he is willing to take his turn in the barrel. Trustee Capaldi and Trustee Laubacher agreed.

Announcements:
A. Stark County Commissioners- Annexation Hearing regarding a portion of Route 30 and Cincinnat Street scheduled for Tuesday, November 15, 2011 at 5:30pm- Township Hall
B. Canton League of Women Voters Hosting Perry Trustee Candidates Night- Wednesday, October 19, 2011 from 6:00pm to8:00pm- Township Hall.
C. Fall Leaf Drop Off- held at 1500 Jackson Ave. SW, Massillon, Ohio 44646- October 15, 2011 through November 20, 2011. Weekdays: 7:00am- 2:30pm, Saturdays and Sundays 8:00am- 3:30pm- Leaves only- No bags, tree limbs, garbage or commercial dumping- Closed November 11th in honor of Veterans Day.

Public Speaks-Open Forum:
Fred Anania- 4061 Knolls Avenue SW. Mr. Anania stated that it is his understanding that Fire Station #2 needs a new 2500 gallon holding tank which is being purchased by the fireman’s association. Mr. Anania stated that he doesn’t feel that it is the association’s responsibility to pay for this and that the Township should pay for it. Chief Martin stated that the frame on the portable tank has degenerated over the years. The Fire Department also has a 1500 gallon back up tank. Chief Martin stated that based on fire history and the use of the 2500 gallon tank he did not feel that it was appropriate to spend the money to buy a whole new tank when there is already a secondary tank. Chief Martin stated that he has approached the metal shop at R.G. Drage who is building a new fame for the 2500 gallon holding tank. Chief Schafer approached Chief Martin wanting to purchase a new holding tank. Chief Martin stated that is entirely up to the association but he was not going to spend that kind of money for a brand new one when there is already a secondary tank in place. Chief Martin stated that is an operational decision on his part. Trustee Capaldi stated that the Board has not been made aware of any purchases made by the Fire Department and the association has been previous purchases to gift to the Township. Chief Martin stated that when you look at the five (5) year history, that tanker has primarily been used for mutual aide purposes outside of the Township. Trustee Capaldi verified that there was adequate storage for the tank water if needed. Chief Martin stated absolutely and if you look at the fires that have been fought over the last five (5) years the amount of water used is well below what the tanker carries. Trustee Capaldi stated that if a donation is made then it has to be brought before the Board at a public meeting. Trustee Chessler verified that there is a back up holding tank and that the 2500 gallon tanker will eventually be back in service. Chief Martin stated that is correct. Trustee Chessler verified that this matter was never presented to the association as “you either pay for the tanker or it’s gone.” Chief Martin stated absolutely not.
Robert Cash- 3124 Woodrich. Mr. Cash expressed his disappointment regarding nothing being done about the drainage along Woodrich. The problems are only getting worse as more time passes. Trustee Chessler asked Mr. Masalko to speak on whether or not the Road Department has been involved with this matter. Mr. Masalko stated that the Perry Township Road Department is involved but it is a matter of priority. Trustee Capaldi verified that Woodrich is still on the list but there have been a number of issues caused by the flooding. Mr. Masalko stated that was correct and it will be handled when it comes up on the list. Trustee Capaldi inquired if it would be taken care of this season. Mr. Masalko stated that he is hoping to have it taken care of this season.
Mr. Cash stated on a good note that he utilized the recycling yard debris program at the Road Department and it worked out well. Mr. Cash advised that he noticed that some residents in Crescent Gardens have been shoving their yard waste down the pipes. Trustee Capaldi asked Mr. Masalko to check on the drainage complaint list and follow up with Mr. Cash on when his complain will be addressed. Mr. Masalko stated that he would follow up with Mr. Cash.
Trustee Capaldi inquired about NPDES and what could be done if residents are dumping yard waste in the pipes. Mr. Masalko stated that this has been a problem before and he will take the leaf collections flyers and hand them to the residents in the neighborhood. Though the Road Department can not be out 24/7 to control this they do try to get out as often as possible to street sweet. This is an issue that the Road Department will have to address with the enforcement help of the Police Department.
